Actions against the police
The types of claims or causes and action you may sue the police for include:
False imprisonment Includes being held in custody or detained at the police station for longer than reasonably necessary, or in breach of the law; being arrested for the wrong reason; or if you have been unlawfully detained, for example a stop and search.
Assault by a police officer This includes falsely imprisoning a person using force or any use of unreasonable force, even if the arrest itself is lawful.
Trespass The police must prove that they have justification to enter onto a person’s land by use of statutory powers or a lawful search warrant.
